Terms and Conditions – Apex Coating Pros LLC

Location: Cheektowaga, New York

1. Agreement

By requesting any services from Apex Coating Pros LLC (“Company,” “we,” or “us”), the customer (“Client,” “you”) agrees to the following Terms and Conditions. These Terms apply to all coatings, decorative concrete, and related services we provide, unless if a waiver is in place.

2. Estimates and Proposals

- All estimates are valid for 30 days from the date issued unless otherwise stated in writing.

- Estimates are based on information provided by the Client. Additional work may be discovered after viewing the project on site, which may result in additional charges.

3. Payment Terms

- A 50% non-refundable deposit is required to secure scheduling and purchase materials.

- You may be responsible for paying full cost upfront depending on Apex Coating Pros, LLC discretion. If not, remaining balance is due on the final project day, or immediately upon completion of services, before final inspection.

- Payments not received within 24 hours after the day of completion may incur a 5% late fee per week.

- Apex Coating Pros reserves the right to suspend work until payments are made.

4. Scheduling & Project Timelines

- Project start dates are scheduled after approval of an estimate or quote.

- Timelines are subject to weather conditions, site readiness, and unforeseen circumstances.

- Delays beyond our control (e.g., power outages, client unpreparedness, moisture issues) can result in rescheduling without liability to Apex Coating Pros.

5. Client Responsibilities

- The Client must ensure work areas are clean, clear, and accessible before scheduled service.

- The Client must provide access to electricity and water on-site.

- Heavy items, vehicles, or obstructions must be removed prior to work. Apex Coating Pros is not responsible for moving personal property.

6. Surface Preparation & Conditions

- Polyurethane Coatings and decorative coatings require proper substrate preparation. We will assess and recommend necessary grinding, repairs, or moisture barriers.

- Moisture or structural issues discovered during installation may require additional services and costs.

- Coating performance depends on environmental conditions; Apex Coating Pros is not responsible for failures due to improper client maintenance, flooding, excessive moisture, chemical exposure, or misuse.

7. Warranty & Limitations

- Apex Coating Pros offers a lifetime warranty covering installation defects.

- Warranty does not cover:

 - Damage caused by improper cleaning, impact, heavy machinery, tire burns, or chemical spills.

 - Structural cracks or movement in the underlying concrete.

 - Moisture-related issues not disclosed or treated before installation.

- Warranty claims must be submitted in writing within 14 days of discovery.

8. Liability

- Apex Coating Pros shall not be liable for indirect, incidental, or consequential damages.

- Maximum liability is limited to the initial deposit amount paid by the Client for the project.

9. Termination & Cancellation

- Deposits are non-refundable once materials are purchased.

- If the client cancels the project within 7 days before scheduled start date, Apex Coating Pros, LLC will retain 100% of the deposit.

10. Non-Payment & Collections

- Failure to pay in full upon completion grants Apex Coating Pros, LLC the right to:

 - Pursue legal action and collection efforts.

 - Apply mechanic’s/contractor liens on the property.

 - Recover reasonable attorney’s fees and costs associated with collection.

11. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of New York.

12. Acceptance

By approval of a estimate, quote, or signing a contract, paying a deposit, or permitting work to begin by scheduling an appointment, the Client acknowledges acceptance of these Terms and conditions.
